Dawn Lake is a single-family home community in Sun City, AZ, centered around a man-made lake. The Homeowners Association (HOA) maintains the lake and common areas. Owners of the 143 lots automatically become members and have easement rights to use the lake, subject to regulations.
- Lake usage & membership: Every lot owner has a non-exclusive easement to use Dawn Lake, which may be delegated to family, guests, or renters. The HOA can suspend usage and voting rights for unpaid assessments (15 days overdue) or uncured non-monetary violations, after proper notice and hearing.
- Boat & dock rules: Boats on the lake are limited to 16 feet in length and must use electric motors (internal combustion motors prohibited after 2004). Each lot is entitled to two boats. Docks: lots with less than 50 feet of frontage get one dock; 50+ feet get two. Docks must be cantilevered, no wider than 16 feet, no more than 6 feet from the lake wall, with 2-inch clearance. New construction or modification requires Board approval (30-day review period).
- Assessments & fees: Annual assessments are set by the Board and cannot increase more than 20% per year (or per Arizona law) without member vote. Special assessments require a 2/3 vote. Late payments incur a late charge (greater of $15 or 10% of unpaid assessment) and 12% annual interest. The Association has a lien on the lot for unpaid assessments and can foreclose. A transfer fee is also assessed upon sale to cover administrative costs.
- Enforcement & penalties: The HOA may impose monetary penalties, suspend membership rights, and sue to enforce rules. All enforcement expenses, including attorneys' fees, become a lien on the lot. The HOA has the right to enter and repair damage caused by an owner and charge the owner.
- Amendment & term: The Declaration runs for 20 years from recording (2003) and auto-renews for successive 10-year periods. Amendments require approval by 60% of all owner votes. The Declaration supersedes any conflicting articles, bylaws, or rules.
