This is the Restated Declaration of Restrictions for Lake Pleasant Estates Homeowners Association, a manufactured/mobile home subdivision in Sun City, AZ. These rules bind all lot owners (homeowners) and, through them, their tenants and guests. The association maintains common areas and enforces standards for homes, lots, and behavior to keep the community safe and attractive.
- What you own & maintain: You own your lot (typically 6,000 or 12,000 sq ft) and the mobile home on it. The association owns and maintains all common areas (private streets, walkways, pool, clubhouse, etc.) and pays for maintenance through assessments you must pay. You must keep your lot clean and landscaped; if you don't, the association can do it and bill you.
- Home requirements: Only one single-family mobile home per lot, minimum 650 sq ft of living space. All homes must be approved in writing by the association for size, condition, and appearance before being brought in. Within 120 days of moving in, you must install an external awning and at least a 10x35 ft concrete slab, and fully landscape the lot. Setbacks: on 6,000 sq ft lots, front 20 ft, rear 10-25 ft (depending on home length), sides 5 ft (10 ft on exterior lots); on 12,000 sq ft lots, front 20 ft, rear 25 ft, sides 7 ft.
- Pets: Only indoor pets are allowed (no farm animals, fowl, or outdoor kennels). Pets must be kept within a fenced area on your lot or on a leash when off your property. You must clean up after your dog. No breeding or selling of pets.
- Vehicles & storage: No boats, travel trailers, motor homes, off-road vehicles, or unlicensed motorized vehicles may be stored in front of your home or on the street. They must be kept behind a fence or barrier not visible from the street. No such vehicle may be connected to septic or water for living or storage purposes. One company sign/logo on a personal vehicle is allowed for overnight parking.
- Business use: No business may be conducted on your lot unless it is not noticeable from outside, complies with zoning, does not involve customer visits, and is reviewed by the board. No business signs are allowed (except the vehicle logo mentioned above).
- Leasing & rentals: You may rent your home, but you (the owner) are responsible for all violations and fines caused by your tenants. You must provide a copy of these CC&Rs to each new owner or occupant before move-in.
- Maintenance & liens: The association can charge you for maintenance it performs on your lot if you fail to keep it up. Unpaid assessments, fees, fines, and interest become a lien on your property. The association can use Arizona lien laws to collect.
- Transfer fee: When you sell your lot, you must pay a transfer fee set by the board. The association can withhold releasing any assessment lien until all amounts due are paid.
