This is the Declaration of Covenants, Conditions and Restrictions for Embarcadero at Ocotillo, a single-family home community in Sun Lakes, AZ. It creates The Embarcadero Community Association, which maintains common areas and enforces rules. All lot owners automatically become members and are bound by these rules, which are in addition to those of the master Ocotillo Community Association.
- What you own & maintain: You own your lot and the residence on it. You are responsible for maintaining your lot and any improvements, while the association maintains common areas (e.g., private streets, landscaping, walls) and the pump station for irrigation and lakes.
- Assessments & fees: Annual assessments fund the association’s operations and reserves. The initial maximum annual assessment per lot was $960. Each year, the board may increase it by up to 10% or by the CPI increase, whichever is greater, without a member vote. Larger increases require a two-thirds vote of members.
- Architectural review: Any improvement visible from neighboring property or in a rear yard backing to a lake requires prior written approval from the Embarcadero Design Review Committee. Approval is based on design harmony, quality, and aesthetics. The committee may charge a fee and require a bond. Exemptions exist for the developer and designated homebuilders.
- Parking & vehicles: No motor vehicle may be parked, kept, or stored on lots, common areas, or streets without approval, except: operable vehicles under 7 ft tall and 20 ft long may be parked in a driveway if the garage is full (no storage). Street parking limited to 24 consecutive hours and 72 hours per week. Oversize vehicles may only park for loading/unloading for up to 24 hours. Inoperable vehicles or those used for commercial purposes are prohibited. Violating vehicles may be towed at owner’s expense.
- Landscaping: Owners must complete landscaping of front and side yards (and rear yards visible from neighboring property or backing to a lake) within 60 days of closing, and other rear yards within 90 days. Landscaping plans require approval from the Design Review Committee.
- Leasing & rentals: The document does not appear to impose specific restrictions on leasing (e.g., minimum lease term or rental caps). Lessees and their residents have the right to use common areas during the lease term. Owners are responsible for violations by their tenants.
- Master community & additional rules: This community is part of the larger Ocotillo master planned development. Lot owners are also members of The Ocotillo Community Association and must comply with its rules, guidelines, and assessments in addition to those in this Declaration.
