- Easement rights for adjacent landowners: Owners of land immediately outside the community have non-exclusive easement rights to cross two private corridors (a 30-foot and 20-foot easement) to access and maintain irrigation facilities serving their property. These easements are for facility access and maintenance only—not for use as roadways or for any other purpose.
- Association maintenance obligations: The association must maintain the irrigation facilities in working order and make necessary repairs. Adjacent owners are responsible for purchasing their own water supply from local authorities.
- Repair procedures & adjacent owner remedies: If the association hasn't completed repairs within 30 days of written notice (or immediately for emergencies), adjacent owners may perform the work themselves and bill the association. Any damage caused by an adjacent owner is that owner's sole responsibility to repair.
- Access control & gate keys: The association may install fences, walls, or gates to restrict access to the easement corridors but must provide keys to adjacent owners who agree to lock and unlock the gate each time they enter and leave.
