What Corona Del Mar I at Ocotillo's governing documents say
This is a Tract Declaration for Corona Del Mar I At Ocotillo, a parcel within the larger Ocotillo master-planned community in Chandler, AZ. It supplements the master declaration and primarily governs the development and use of this specific parcel, which is designated for single-family residential use. The document is addressed to property owners, builders, and the homeowners association, and it imposes certain obligations and easements related to land use, construction approval, and common area maintenance.
- Land use classification: The parcel must be developed and used solely for single-family residential use, as authorized by the master declaration.
- Approval of development: No building permit or construction may begin without prior written approval from the Declarant (developer) of the uses, development plan, plans and specifications, landscaping, and any necessary easements. Plans must also be reviewed by the Association and Design Review Board under the master declaration.
- Limitations on further subdivision: The parcel cannot be subdivided into smaller lots unless permitted by law and approved in writing by the Declarant and the Association. If subdivided, obligations and liabilities apply proportionally to each lot.
- Effluent and inundation easement: Effluent is not required for residential lots but will be used for common area landscaping. A permanent inundation easement exists over portions of the parcel below 1,190 feet above mean sea level, and owners of such areas assume liability for flood damage.
- Common area maintenance & special use fee: Tracts A, B, and C (landscaped open areas) will be maintained by the developer until conveyed to the Association. After conveyance, the Association will maintain them in exchange for a Special Use Fee—initially capped at $168 per lot per year for Lots 1–44, with annual increases allowed up to the percentage change in Annual Assessment, subject to actual maintenance costs.
- Association membership: The parcel is initially designated with 44 memberships. Upon subdivision plat recordation, the number of memberships will be adjusted, and an amendment to this Tract Declaration will be recorded.
- Enforcement: The Declarant has the right to enforce this Tract Declaration; any enforcement costs incurred by Declarant are reimbursed by the Association, which may in turn assess those costs as a special assessment against the owner in breach.
- Amendment: The Declarant may make non-material amendments related to site plan approval or membership adjustments. Other amendments require compliance with Article XIII of the master declaration.
