What The Shops at Ocotillo's governing documents say
The Shops at Ocotillo is a commercial and retail development complex in Chandler, Arizona, covering approximately 12 acres. This governing agreement establishes the rules that bind property owners holding individual parcels within the development—defining shared common areas, easements for utilities and circulation, architectural standards, parking requirements, and restrictions on commercial activity outside building envelopes.
- What you own & maintain: You own your individual parcel and the buildings/improvements on it. The developer (Declarant) or an appointed Manager maintains the shared common areas—circulation drives, parking areas, landscaping, and lighting.
- Easements & shared infrastructure: Others have the right to use portions of your property for parking, pedestrian and vehicle access, utilities (water, sewer, electric, gas, fiber, cable), and storm water drainage. Utility lines on your property must be at least 10 feet from buildings or installed underground.
- Parking requirements & restrictions: Parking requirements are strict and lot-specific. Designated parcels must provide specific ratios based on use type (e.g., 8.5 spaces per 1,000 sq ft for large restaurants, 4.0 for other uses). Overnight parking of semi-trucks or trailers is prohibited except for construction, and employee parking is restricted to designated areas.
- Architectural review & development control: All buildings and exterior alterations must be approved by the developer before construction. Buildings must stay within designated envelopes on the site plan and meet maximum floor area and height limits. All construction must be first-quality and architecturally harmonious with the development.
- Commercial activity restrictions: No merchandise sales, food trucks, kiosks, vending machines, spinning signs, political demonstrations, or promotional activities are permitted in common areas or outside your building. All business must occur within your building envelope.
- Common area maintenance standards: Common areas are for circulation, parking, and loading only—no permanent barriers or obstructions allowed. No rubbish, offensive odors, or loud exterior sound is permitted, except business-related music, security alarms, and outdoor dining area speakers.
- What this document doesn't cover: This excerpt is truncated and omits details on assessment amounts, management procedures, enforcement remedies, and amendment processes. Individual parcels may be subject to Secondary CC&Rs with additional restrictions.
