What Windward at Ocotillo's governing documents say
Windward at Ocotillo is a single-family home community in Chandler, AZ, governed by a homeowners association (Windward Community Association). This Declaration of Covenants, Conditions, Restrictions & Easements sets the rules for all lot owners, including use restrictions, assessment obligations, and architectural controls. The community is part of the larger Ocotillo master-planned community, so owners are also subject to Ocotillo's master documents and design review board (ODRB).
- Property use & leasing: Lots are for single-family residential use only; no business or non-residential use allowed. Leases must be for 60 days or longer, and a copy of the lease must be provided to the association. Tenants must agree to follow all governing documents.
- Architectural review: All exterior improvements, alterations, landscaping, fences, and color changes require prior written approval from the Ocotillo Design Review Board (ODRB). Landscaping must be installed within 120 days of close-of-escrow, and plans must be approved. No structures may be built without ODRB approval.
- Assessments & fees: Annual assessments start at a maximum of $1,600 per lot, with automatic annual increases up to 5% or CPI. Special assessments require 2/3 member vote. A capital reserve fee equal to 1/2 of the current annual assessment is due from each new buyer (other than the developer). A transfer fee of $125 (initial) may be charged on resales. Delinquent assessments incur a late fee of $15 or 10% per annum, plus 15% interest and collection costs.
- Vehicles & parking: On-street parking is generally prohibited; vehicles must be kept in garages or driveways. No vehicles exceeding 3/4 ton, boats, trailers, or recreational vehicles may be visible from neighboring property, except pickup trucks and mini motorhomes under 7 ft height and 18 ft length used for basic transportation. No inoperable or abandoned vehicles allowed. Temporary on-street parking for loading, guest visits, and special events is permitted as limited by the Board.
- Pets & animals: Only a reasonable number of generally recognized house pets are allowed, kept solely as domestic pets (not for commercial purposes). No animal may create excessive noise or nuisance. Animal enclosures must not be visible from neighboring property.
- Signs & exterior items: No signs except one name/address sign (max 9x15 inches) and one temporary sale/rent sign (max 5 sq ft). Clotheslines are prohibited unless hidden from view. Antennas and satellite dishes must not be visible from neighboring property unless approved under FCC regulations. Window coverings must be installed within 90 days of occupancy; reflective materials are banned.
- Common areas & amenities: The association maintains common areas including private roadways, an access gate (initially 2 remotes per home, additional at $75 each), and lakes used for aesthetics, boating, and catch-and-release fishing. Swimming and wading are prohibited. No guard service is provided. The city is not responsible for maintenance of private areas.
- Dispute resolution & defects: Owners must give written notice of alleged construction defects to the developer within 15 days of discovery. The developer has the right to inspect and repair. Legal actions are subject to the procedures in Article X of the declaration.
