This Tract Declaration annexes new property (Unit Thirty-Nine) to the existing community, establishes land use classifications for those parcels, and clarifies the age-occupancy rules that apply. It supplements a master Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that contains the full rulebook.
- Age restriction (55+): The community is intended for occupancy by persons 55 or older. At least 80% of occupied units must have one occupant 55+ to maintain exemption from fair housing familial-status rules. No one under 19 may reside permanently. Owners must immediately notify the association if a unit no longer has a 55+ occupant.
- Board discretion for younger occupants: The board may allow a unit to be occupied by persons all under 55, as long as at least one occupant is 40 or older, and total occupancy stays within the 80% 55+ requirement. The board decides based on criteria including pending occupancy changes and ages of nearby residents.
