Duskfire Unit Two is a single-family home subdivision in Tempe, AZ — a standard subdivision with deed restrictions that run with the land (not a condominium or HOA). All homeowners must follow these covenants; there is no mandatory association or common fees.
- Architectural review & approvals: Any building, fence, wall, antenna, or structure requires prior written approval from the Architectural Committee (initially Eugene Cox, Clair Lane, Kim Ewing). Plans and specs must be submitted; failure to reject within 15 days constitutes approval. The committee may reject for aesthetic or harmony reasons. Original construction by the developer is exempt.
- Minimum home size & construction timeline: Each dwelling must have at least 1,650 square feet of ground floor area (excl. porches, garage). Construction must be completed within one year of obtaining a building permit. Front yard landscaping must be finished within 8 months of the certificate of occupancy.
- Use restrictions: Lots are for single-family residential use only. No business, commercial activity, or medical/institutional use. No oil drilling, mining, or business signs (only one "For Rent" or "For Sale" sign per lot, max 5 sq ft). No temporary structures, trailers, or basements used as residences.
- Fencing & walls: Fences and walls must be masonry (except developer-installed). No solid wall/fence over 3 ft high within 10 ft of the front street line; side/rear fences max 7 ft (except tennis courts). Dividing-line fences between lots are shared maintenance cost. All fence materials and colors need Architectural Committee approval.
- Pets: Only household pets allowed, must be reasonable in number and not create a nuisance. No livestock, poultry, or other animals.
- Vehicles & storage: No abandoned or inoperative vehicles visible from other lots or streets. No auto dismantling on the lot. Garbage, trash, and unsightly items must be screened from view and not accumulate.
- Property maintenance & damage: Each owner must keep the lot free of weeds and in neat condition. If a home is destroyed, it must be rebuilt within 18 months. Front yard landscaping must be maintained. All utility and drainage easements must be kept clear.
- Duration & amendment: These covenants run for an initial 35 years (from 1980) and automatically renew for 10-year periods unless 75% of lot owners vote to revoke. Amendments require 75% owner approval.
