Warner Ranch Village Unit I (Tempe, AZ) is a planned community of individually owned residential lots with shared common areas, governed by an association funded by per-lot assessments. The declaration establishes maintenance obligations, insurance requirements, voting rights, and community rules.
- What you own & what the association maintains: You own your individual lot and the structure on it; the association owns and maintains all common areas, landscaping, boundary walls, private streets, and the front-yard landscaping on each lot. The association also maintains public rights-of-way for Warner Road, Warner Ranch Drive, and Forest Street.
- Party walls & shared structures: If your residence shares a common wall with an adjacent unit, you and that neighbor share responsibility for the maintenance and repair of that shared wall, governed by general Arizona property law.
- Assessments & fees: Assessments begin at $60/month (through Dec 31, 1985), then $720/year (1986 onward), paid in two installments (Jan 1 and July 1). - Rules & enforcement: The board may enact reasonable rules; violations can result in suspension of voting rights and common-area facility use (up to 60 days) or reasonable monetary fines (if approved by majority member vote). You must maintain your lot's exterior in good condition consistent with community standards.
- Voting & membership: Each lot owner has one Class A membership and one vote per lot. The developer initially held Class B memberships with 3 votes per lot, but this status terminates on June 1, 1989, or earlier if owner votes reach or exceed developer votes.
- Damage, destruction & rebuilding: If major damage occurs, the board uses insurance proceeds to repair or rebuild unless owners (75% of lots) and eligible mortgage holders (51%) vote not to repair, with city approval. If reconstruction is declined, the damaged area is maintained as undeveloped common area.
