Hohokam 56 Center is a commercial/retail condominium in Tempe, AZ — you own a commercial unit (office, retail, or service space) and share ownership of the building's common areas with other unit owners. The association maintains common elements, carries master insurance, and oversees limited common elements like parking and some roof areas; you maintain your unit's interior and certain limited common elements (e.g., HVAC system). Note that a separate master association (Hohokam Industrial Park) imposes additional restrictions and assessments.
- Use & occupancy: Units are restricted to retail, commercial, and service establishments only. No residential use is permitted.
- Maintenance responsibilities: You maintain your unit interior and your allocated limited common elements (e.g., HVAC, which must be inspected at least annually). The association maintains common elements, building exteriors, parking spaces, utility rooms, and the 6-foot overhang. - Leasing & rentals: Leases must be in writing and subject to all condo documents. You must provide the association with tenant info (names, contact, vehicles) before occupancy. You remain personally liable for tenant violations. No minimum lease term is specified.
- Parking & vehicles: Each unit is allocated covered parking spaces (see Exhibit C). Building A has exclusive uncovered spaces; Building B units share uncovered spaces. No vehicle repair, storage of inoperable vehicles, or parking outside designated spaces is allowed. The association may tow violators at owner expense.
- Alterations & improvements: Non-structural interior changes do not require association approval. Structural alterations (e.g., modifying walls) need prior written approval, plans, and an engineer's certification that structural integrity is not impaired. Changes to common elements require association approval.
- Pets & animals: No pets, birds, poultry, or livestock are allowed except fish kept in aquariums and service animals for disabled persons.
- Signs & exterior appearance: Exterior signs, including 'For Sale' or 'For Rent' signs, require association approval (except Declarant signs and required legal signs). Reflective materials on windows are prohibited without approval. Window coverings and other exterior modifications must be approved.
