Knoell Gardens is a subdivision of single-family residential lots in Tempe, AZ, governed by a Declaration of Restrictions (Covenants, Conditions & Restrictions) recorded in 1973. The covenants run with the land and bind all lot owners. There is no homeowners association; these are deed restrictions enforced by owners.
- What you own & maintain: Each lot is for a single-family detached dwelling only. You own the lot and are responsible for maintaining your house and yard. No outbuilding may be used for residence, and only one dwelling plus a garage or carport (max 3 cars) is allowed per lot.
- Construction & design: All construction must be new (no moved buildings). Minimum living area is 800 square feet. Front setback is 20 feet, side setback is 14 feet (unless on lot line), rear setback is 12 feet (except fences). Zero-lot-line walls create an easement of 3 feet on the adjoining lot for maintenance.
- Use restrictions: No livestock (horses, cows, sheep, goats, poultry, rabbits, swine) are allowed. No business, store, office, hospital, nursery, theater, saloon, or church may be conducted on any lot. No house trailers or abandoned/inoperable vehicles visible from other lots or streets.
- Party walls & easements: Owners sharing a party wall or fence have equal rights to use it. Damage caused by an owner must be repaired at that owner's cost; damage from other causes (including ordinary wear) is shared equally. No structural changes without all owners' consent. An easement of 3 feet exists over lots with zero-lot-line walls for maintenance purposes.
- Duration & amendments: These covenants run with the land until March 17, 2000, and automatically renew for successive 10-year periods unless a majority of lot owners vote to change them. Invalidating one covenant does not affect the rest.
