What Tempe Homestead's governing documents say
Tempe Homestead is a single-family homeowners association in Arizona. These three documents are amendments and a one-off variance to the original 1994 declaration, not the complete governing rulebook — they address rental restrictions, a landscaping requirement, and one lot's setback exception.
- Leasing & rentals: Owners cannot rent for short-term, transient, or month-to-month purposes. All rentals must be for a minimum of 12 months and require Board pre-approval. Rental agreements must be in writing and must expressly state that tenants are bound by all HOA rules; if a tenant violates them, the owner is in default.
- Landscaping requirement: Each lot owner must plant at least one 24-inch boxed Schamel Fan Tail tree in the front yard as part of required landscaping.
- Setback variance (Lot 3 only): Lot 3 was granted an after-the-fact variance in 1999 allowing a 25-foot front and rear setback instead of the standard 30-foot requirement. This exception applies only to Lot 3 and does not waive the 30-foot rule for other properties.
- What this document doesn't cover: These are three amendments to the original 1994 Declaration of Covenants, Conditions and Restrictions, not a complete governing document.
