Torre Molinos is a planned residential development (townhome community) of 160 lots in Tempe, AZ, governed by a homeowners association. The association maintains common areas, building exteriors, and front/rear landscaping; owners maintain interior and interior patios. This document is the full set of covenants, conditions, and restrictions binding all owners and residents.
- Party walls & shared structures: Many lots share party walls that are maintained jointly. If damaged by an owner, that owner must repair within 30 days. Disputes go to arbitration. No attachments that create noise or penetrate more than 3 inches.
- Maintenance responsibilities: The association maintains common areas, building exteriors (painting, roofs, gutters), and all landscaping outside patio walls. Owners maintain interior, interior patio fences/flooring, and all utilities within lot boundaries.
- Assessments & fees: Annual assessments fund common area maintenance, insurance, and operations. Special assessments for capital improvements require a 2/3 vote of members after the developer transfers control. Unpaid assessments bear 8% interest and can become a lien.
- Insurance: The association carries master property insurance on all buildings and common area with at least $500,000 public liability. Owners may insure personal property and personal liability separately.
