What Broadway Palms's governing documents say
Broadway Palms in Tempe, AZ is a single-family residential subdivision governed by a Declaration of Restrictions recorded in 1973. These covenants run with the land and apply to all lot owners in the subdivision, regulating lot use, building size, setbacks, fences, and architectural review. The restrictions automatically renew every ten years unless a majority of owners vote to change them.
- Minimum floor area: Each dwelling must have at least 1,000 square feet of ground floor area, excluding garages, porches, and patios. No more than one residence per lot, and no residence over one story.
- Setbacks & building envelope: Front setback: 25–34 feet from front property line. Side setbacks: 7 feet on interior lots; corner lots require 10 feet from side street line and 5 feet from interior lot line. Garages detached and on rear third of lot have different rules.
- Architectural review: No structure may be built until its design, location, and materials are approved in writing by a two-person committee (initially named Ellis W. Suggs and John T. Owens, later elected by lot owners after 75% of lots are sold). If the committee fails to act within 30 days, approval is not required.
- Fences & walls: Front fences or solid walls cannot exceed 2.5 feet in height and must be behind the front building line. Side and rear fences/walls up to 6 feet. Hedges nearer than 20 feet to the front lot line limited to 3 feet in height.
- Livestock: No livestock is permitted on any lot.
- Lot subdivision & use: Lots cannot be resubdivided into smaller lots, except for public utilities. Adjoining contiguous lots under common ownership may be treated as one lot.
- Utilities & sanitation: All toilets and sanitary conveniences must be inside buildings. Until public sewers are available, septic tanks and dry cesspools are required. Once sewers are available, connections are mandatory.
- Term & amendment: The restrictions run until June 1, 1995, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them in whole or part.
