What Crystal Point Estates's governing documents say
This is a First Amendment to the Declaration of Covenants, Conditions and Restrictions for Crystal Point Estates, a single-family home community in Tolleson, AZ. It modifies rules about dock maintenance, walkways to docks, and fencing near the beach easement. It does not contain the full set of community rules.
- Dock maintenance: Owners adjacent to a dock they benefit from are responsible for all maintenance, painting, repairs, replacements, and restoration, except the bumpers on Lots 3 and 4, which the association maintains.
- Walkways to docks: Lot owners may build a walkway to docks across the beach easement area above sand level but no higher than the dock deck level, and not extending beyond the dock size (dual lot owners with adjacent docks may have larger walkways). Prior written approval from the Architectural Control Committee is required.
- Fence requirements: front/beach side: Before house occupancy, a six-foot-high fence must be built from the house to the side lot lines and back to end 7–10 feet from the beach easement. Then a two-foot-high fence continues to the beach easement.
- Backyard enclosures: Owners may enclose the backyard with a five-foot-high wrought iron fence. A three-foot-high wrought iron addition to the two-foot beach fence is allowed with written agreement between adjacent owners and association approval. Gates must be wrought iron with cedar or redwood inserts, painted in a uniform color designated by the committee. Pool areas may have a block wall up to two feet high with wrought iron above to five feet. Contiguous owners can agree to skip a party wall on the property line.
