What Fieldcrest's governing documents say
Fieldcrest is a standard single-family homeowner association (HOA) in Tolleson, AZ. This document is the Declaration of Covenants, Conditions, Restrictions and Easements (CC&Rs) that applies to all homeowners, prospective buyers, and renters. It defines the rules for property use, maintenance, assessments, and architectural control within the community.
- Use restrictions: All lots must be used exclusively for single-family residential purposes. No commercial activities, businesses, or home occupations are allowed. No further subdivision or conversion to condominium without Board approval.
- Architectural review: Any exterior alteration, improvement, or structure (including fences, sheds, antennas, and color changes) requires prior written approval by the Architectural Committee. Plans not approved within 60 days are deemed approved. Basketball standards visible from neighboring property are strictly prohibited.
- Assessments & fees: Annual assessments start at a maximum of $39 per lot (payable monthly) as of 2001, with automatic annual increases tied to the greater of 10% or CPI. Special assessments for capital improvements require 2/3 member vote. Unpaid assessments accrue 12% interest and become a lien on the property.
- Maintenance responsibilities: The Association maintains Common Areas and front yard landscaping. Homeowners are responsible for the rest of their lot (lawns, plantings, repairs) and must keep it free of weeds and debris. No alterations to front yard landscape without permission.
- Leasing & rentals: Leases must be in writing and expressly subject to the Declaration. The homeowner remains liable for tenant compliance. The Association must be notified of leases. No minimum lease term is stated.
- Parking & vehicles: Vehicles must be kept in garages, carports, or driveways. No parking of boats, trailers, campers, or vehicles over 1 ton on lots or streets visible from neighboring property. Inoperable vehicles and on-street parking are restricted.
- Pets: Only a reasonable number of domestic pets are allowed, kept as pets not for commercial purposes. No excessive noise or nuisance. Structures for animal housing must not be visible from neighboring property.
- Party walls & fences: Owners sharing a party wall or fence are jointly responsible for repair and maintenance (unless damage caused by one owner). Disputes are resolved by the Board. Walls adjacent to streets or Common Areas may have specific obligations.
