What Anderson Farms Property Owners Association's governing documents say
Anderson Farms is a single-family home subdivision in Carolina Shores, NC, governed by a Master Declaration and Development Plan. The rules apply to all lot owners and run with the land. The community allows site-built homes, double-wide, and single-wide manufactured homes, subject to specific size and age restrictions.
- Allowed home types & minimum sizes: Single-family residences may be site-built, double-wide (minimum 24' x 36'), or single-wide manufactured homes (minimum 14' x 60'). Mobile homes must be no more than 3 years old when placed, unless approved by the Declarant. Site-built homes cannot be smaller than the double-wide minimum.
- Architectural & exterior approval: Site-built homes and site-built additions to mobile homes require prior approval of architectural plans, including exterior materials and color schemes. Appurtenant buildings must have siding similar to the main dwelling and be approved by the Declarant.
- Setbacks & structures: All structures must be set back at least 30 feet from the street right-of-way and at least 10 feet from side and rear lot lines. Fences, gates, or other structures exceeding 3 feet in height require prior approval. Satellite dishes and outside TV antennas are prohibited.
- Vehicles & parking: No stripped, wrecked, or junk vehicles may be parked on streets or lots. Motorcycles, motorbikes, and similar motorized vehicles may only be used for access to/from lots, not for recreational riding. A fine (up to the legal amount for driving without a license) may be levied for violations.
- Pets & animals: Only usual domesticated household pets are allowed. Horses, poultry, fowl, cattle, and other livestock are prohibited.
- Property maintenance & nuisances: All lots must be well-maintained, free of rubbish, debris, and conditions conducive to pests. No noxious or offensive activities are allowed. The Declarant may enter a lot to correct violations and charge the owner.
- Assessments & fees: The association (once formed) may levy uniform annual charges and special assessments (with 60% owner vote). Prior to association formation, the Declarant sets a private street maintenance fee of $50 per lot (lots abutting SR 1305 are exempt), which can increase only by CPI (base January 1986). Fees, fines, and charges constitute a lien on the lot.
- Streets & amenities: Streets are private, owned by the Declarant until transferred to the association. The association's purposes include maintaining private streets, amenities, common areas, and drainage systems. The Declarant may establish rules for street and amenity use before association formation.
