What Brookgreen Homeowners Association's governing documents say
Brookgreen is a single-family home HOA in Cary, NC, part of the larger Parkway Planned Unit Development. This declaration sets the rules for homeowners in the Brookgreen subdivision, covering property use, maintenance, assessments, and architectural control.
- What you own & maintain: You own your lot and detached single-family home. The HOA maintains common areas, buffer areas, and sidewalk easements, funded by your annual assessments.
- Assessments & fees: Annual assessments are set by the Board, initially capped at $48 per lot (1990) and can increase up to 10% per year without a vote. Special assessments for capital improvements require a 2/3 vote. At closing, buyers pay a two-month assessment into reserves.
- Architectural review: Any exterior construction, alteration, or addition (including fences, sheds, and painting) requires prior written approval from the Declarant or the HOA. Approval is deemed given if no response within 60 days.
- Land use & structures: Lots are for residential use only, with one detached single-family dwelling. Temporary structures, trailers, and metal storage buildings are prohibited. Storage buildings are allowed in rear yards with approval.
- Pets & animals: No animals, livestock, or poultry may be raised or bred for commercial purposes. Dogs, cats, and other household pets are allowed, subject to HOA rules, and must be kept in a fenced rear yard when outdoors.
- Parking & vehicles: Unlicensed or disabled vehicles must be parked in an enclosed garage. Boats, trailers, and campers must be in a garage or on approved parking pads in side or rear yards.
- Signs & satellite dishes: Only one professional 'for sale/rent' sign (max 5 sq ft) and owner identification signs are allowed. Satellite dishes and outdoor clotheslines are prohibited without written approval.
- Tree removal & landscaping: Trees with a trunk diameter over 6 inches (measured 4 feet above ground) cannot be removed without HOA approval, except dead, diseased, or dangerous trees. Buffer areas must remain undisturbed.
