What Glen at Westhigh Owners Association Inc's governing documents say
This is the Declaration of Covenants, Conditions and Restrictions for Glen at Westhigh, a planned single-family residential community in Cary, NC, governed by the Glen at Westhigh Owners Association. It applies to all lot owners, residents, tenants, and guests, and it establishes the rules for property use, common areas, assessments, and architectural control.
- What you own & maintain: You own your lot and home; the association owns and maintains the common areas (e.g., streets, open space, amenities) funded by your assessments. You must maintain your lot and any easements on it, and the association can enter your property for maintenance with notice.
- Leasing & rentals: You may rent your home, but leases must be in writing, subject to the governing documents, and for more than 30 days (no hotel/transient rentals). You must notify the association of the tenant and provide a copy of the lease. You remain responsible for assessments even if the tenant pays.
- Architectural review: An Architectural Control Committee (ACC) must approve new construction, modifications, and alterations. You must submit plans for approval before making exterior changes.
- Assessments & fees: The association levies annual assessments to cover common expenses, and can levy special assessments. If you are more than 30 days delinquent, the association can suspend services and use of common facilities, and fines for violations can be up to $100 per day after a 5-day grace period.
- Common area use & amenities: All owners have a right to use the common areas, but the association can limit guests, charge fees for some facilities, and suspend use for unpaid assessments or rule violations (up to 30 days). Tenants may use common areas while living there, but renting owners lose that right during the tenancy.
- Rules & enforcement: The association can adopt rules and regulations, and enforce them with fines, suspension of voting rights and common area use, and self-help. You must comply with all governing documents, and the declaration prevails over other documents.
- Subdivision & time-sharing restrictions: Lots cannot be further subdivided or partitioned without association consent, and time-sharing or sequential ownership interests are prohibited.
- What this document doesn't cover: This excerpt does not include specific architectural guidelines, the full rules and regulations, or the current assessment amounts. It also doesn't cover any age restrictions or pet rules.
