What Lakehogan's governing documents say
Lake Hogan Farms is a master-planned residential community in Chapel Hill, NC, governed by a declaration of covenants that applies to all properties within it. This document is the main rulebook for homeowners, covering architectural control, land use, environmental protections, and open space easements. It establishes a homeowners association and gives the developer broad discretionary powers over design and land management.
- Architectural review: No building, fence, or structure may be erected or altered without prior written approval from the Company, which can deny approval for any reason, including purely aesthetic ones. Plans must include specifications, plot plan, and land management plan; approval is deemed granted if not denied within 30 days of written demand.
- Environmental & land management: Alteration of topography or vegetation requires prior written approval; trees 6 inches or more in diameter at 2 feet above ground cannot be removed without approval. The Company may enter properties to correct erosion, control insects, or remove unsightly growth, with costs charged to the owner after notice.
- Parking & vehicles: Each owner must provide off-street parking before occupancy; driveways must be paved. No vehicles may be parked within street rights-of-way between 2:00 and 6:00 A.M. Boats, trailers, campers, and oversized vehicles must be kept in enclosed areas not visible from adjacent properties.
- Pets & animals: No animals, livestock, or poultry may be kept except dogs, cats, or other household pets, provided they are not kept for commercial purposes and are under control at all times.
- Use of Lake Hogan: Swimming and motorized watercraft or flotation devices are prohibited in Lake Hogan; all other uses are subject to Company regulations.
- Signs & mailboxes: No signs may be erected without written approval, and the Company may remove violating signs at the owner's expense. Mailboxes must be approved for design, color, and location, and the Company may establish uniform regulations.
- Residential use & structures: All residential properties must be used for residential purposes; only one detached single-family dwelling is allowed per lot (except for multiple-family tracts). Mobile homes, trailers, tents, and temporary structures are prohibited, except contractor shelters during construction. Exteriors must be completed within 1 year (single-family) or 2 years (multiple-family) of construction start.
- Open space & community facilities: Public and Community Open Space areas are set aside for owner enjoyment, subject to Company rules. The Company may build recreational facilities (tennis courts, pools, trails, etc.) and may convey open space to the Association. No dumping or antennas are allowed in open space.
