This is a Declaration of Access and Utility Easement for a small planned development of three single-family lots on Hillandale Road in Durham, NC. It is not a full HOA rulebook—it only creates a shared driveway and utility easement and outlines maintenance responsibilities among the three future homeowners.
- Shared driveway & utility easement: A 20-foot strip along the northern edge of the property is set aside as a permanent, non-exclusive easement for pedestrian/vehicular access and utilities serving all three lots. No barriers, fences, parking, or stored materials are allowed within this easement.
- Driveway maintenance & cost sharing: The owner of the lot closest to Hillandale Road is responsible for ongoing maintenance of the shared driveway. All three lot owners must equally share the actual costs (no markup), and the Hillandale owner can invoice the others, who have 30 days to pay. Each owner must also pay for damage caused by their own extraordinary use.
- Repairs & liens: If an owner fails to maintain the driveway or repair damage they caused, other owners can step in after 60 days' written notice (or immediately in an emergency) and bill the responsible owner. Unpaid invoices can become liens on the responsible owner's lot, subject to any first mortgage.
- Utility installation: Any owner installing utilities within the easement must notify and coordinate with the other owners, minimize disruption, and pay all costs, including restoring any affected areas.
- Amendments & estoppel certificates: This declaration can only be changed by a written agreement signed by all lot owners and recorded. Owners must provide estoppel certificates within 10 business days of a request from a buyer, lender, or tenant.
