This is a declaration of condominium for The Carmichael Condominium, a three-unit mixed-use condominium in Durham, NC, established in 2013. It governs the rights and obligations of unit owners, who each own a unit and share common elements, and is relevant to current or prospective owners of Units 1, 2, or 3.
- What you own & maintain: Each unit owner owns the airspace within their unit's boundaries (defined by the plat) and an undivided interest in the common elements. The association maintains the common elements, while each owner is responsible for maintaining their unit and all improvements on it, including exterior building surfaces, windows, doors, and HVAC equipment.
- Architectural review: Any improvement that changes the exterior appearance of the property—such as buildings, fences, parking areas, landscaping, or signage—requires written approval from the association before construction or alteration. The association may object if the plans are aesthetically disruptive, violate the declaration, or are inconsistent with first-class mixed-use developments in the area.

- Subdividing units: Unit owners may subdivide their unit into two or more units, either by recording an amendment to the declaration or by subjecting the unit to second-tier condominium documentation, as long as the second-tier documents are subordinate to this declaration.
