Milan Woods is a single-family home HOA in Durham, NC, governed by a Declaration of Protective Covenants. This document binds all lot owners, who automatically become members of the Milan Woods Homeowners Association. It covers assessments, maintenance, architectural control, and use restrictions for the community.
- Assessments & fees: Annual assessments start at $150 per lot (through 1987) and can be increased by the Board up to 10% per year without a vote; larger increases require a 2/3 vote of each class. Special assessments for capital improvements also require 2/3 approval. Assessments are a lien on the lot, and unpaid amounts accrue interest at 8% per annum. At closing, buyers must pay a sum equal to three months of assessments, which is non-refundable.
- What you own & maintain: You own your lot and the single-family dwelling on it. The Association owns and maintains the Common Areas (including any amenities), funded by assessments. Lot owners are responsible for maintaining their own property; if they don't, the Board can step in after 30 days' notice and bill the owner, with a lien for non-payment.
- Architectural review: Any construction, exterior alteration, fence, wall, or other improvement requires prior written approval from the Declarant or the Association's architectural committee. Approval is deemed given if no response within 30 days of submission, but only if the plans are complete. In general, changes must be in harmony with existing structures and not obstruct views.
- Land use & building rules: Lots are for residential use only, with one detached single-family dwelling (max 3 stories) and up to two private garages. Dwellings must have at least 1,000 square feet of heated living area. Temporary structures, trailers, and tents cannot be used as residences. Lot size and setbacks must meet Durham City Code.
- Pets & animals: No animals, livestock, or poultry may be raised or kept, except dogs, cats, or other household pets, provided they are not kept for commercial purposes.
- Parking & vehicles: The Board can make rules about parking, including banning campers, boats, trailers, trucks, and commercial vehicles from streets, common areas, or lots, and limiting vehicle repairs. Vehicles parked on streets or common areas must have valid license plates.
- Signs & exterior appearance: No signs are allowed except one professional sign (max 5 sq ft) for sale/rent, and owner/street number identification. Television antennae, satellite discs, and outdoor clotheslines are prohibited unless approved. Garbage cans and clotheslines must be kept in rear yards, out of street view.
