This is the declaration of covenants, conditions, and restrictions for Windermere Ridge Townhomes, a townhome community in Durham, NC, where you own your unit and the land it sits on, and the association maintains common areas and building exteriors. It binds all current and future owners, and this document is the full rulebook for the community.
- What you own & maintain: You own your townhome lot and interior; the association maintains common areas, private streets, driveways, parking lots, and the exteriors of all townhomes (roofs, siding, gutters, etc.), except glass and underground waterproofing. You may maintain your rear yard (with some exceptions) but not the front yard without approval.
- Assessments & fees: Annual assessments are set by the board, with a maximum of $900 per lot per year until Dec 31, 2005, then can increase up to 5% per year without a vote; larger increases need a 2/3 vote. Special assessments for capital improvements also require a 2/3 vote. Unpaid assessments accrue 8% interest and can become a lien on your property.
- Leasing & rentals: The declaration does not restrict leasing or require minimum lease terms, but owners may delegate their common area use rights to tenants. Renters must follow all community rules.
- Pets: Reasonable number of household pets allowed, but no livestock or poultry, and pets cannot be kept for breeding or commercial purposes or be a nuisance to neighbors.
- Architectural review: Any new building, fence, wall, or exterior change requires written approval from the architectural committee (or board) before starting; if no response within 30 days, approval is presumed. Satellite dishes 18 inches or smaller are allowed if unobtrusive.
- Parking & vehicles: Each lot is entitled to up to two parking spaces. The association may prohibit boats, campers, trailers, and commercial vehicles on common areas, and may assign specific spaces.
- Use restrictions: Lots are for single-family residential use only; no commercial activity (except home office with no customer traffic), no nuisances, no exterior speakers, no clotheslines, no window air conditioners, no temporary structures, and no signs except name/address and one 'for sale' sign.
- Party walls: Shared walls between townhomes are party walls; repair costs are shared proportionally to use, and disputes go to arbitration.
