What Sunsetglen's governing documents say
This is an amendment to the Declaration of Covenants, Conditions, and Restrictions for Sunset Glen, a single-family home HOA in Fuquay-Varina, NC. It adds strict rules about renting out homes, aiming to keep the neighborhood mostly owner-occupied. The rules apply to homeowners, not renters directly, and are important for anyone considering buying a home here as an investment or planning to rent.
- Leasing & rentals: Homes must be owner-occupied for at least 12 consecutive months before they can be rented, except in cases like the owner's death. Only 5 of the 46 homes can be rented at any one time, and leases must be for at least 12 months. Short-term rentals (like Airbnb) and subleasing are prohibited.
- Leasing permits & waiting list: To rent, owners must apply for a one-year Leasing Permit from the HOA board. Permits are renewable once, but if there's a waiting list, they won't be renewed for consecutive years. If the 5-home cap is reached, owners are placed on a waiting list and get a permit when one becomes available.
- Hardship & special permits: The board can grant Hardship Permits to exceed the cap for situations like military deployment, job loss, or serious illness, allowing a lease for up to 12 months. Owners who have lived in their home for 5+ years can get a Special Permit to rent even if the cap is met, as long as the total rented homes doesn't exceed 7.
- Restrictions on multiple ownership: No person or entity can hold a Leasing Permit for more than one lot, and owners must be 'Distinct Lot Owners'—meaning they can't have an ownership interest in another Sunset Glen lot, directly or indirectly. This prevents investors from owning and renting multiple homes.
- Lease requirements & tenant screening: All leases must be in writing, cover the entire home, and include a clause requiring tenants to follow HOA rules. Owners must provide tenants with the governing documents, get a signed acknowledgment, and submit a copy of the lease and criminal background checks for all adult occupants to the board within 15 days of signing.
- Enforcement & fines: Violating the leasing rules can result in fines up to $100 per day (after a 5-day grace period), legal fees, and other enforcement actions. Owners are also responsible for their tenants' violations.
- What this document doesn't cover: This is only an amendment to the HOA's declaration, so it doesn't cover other typical rules like architectural review, parking, pets, or maintenance responsibilities. Those would be in the original declaration and other governing documents.
