Avalon Springs is a planned community in Fuquay-Varina, NC, governed by a homeowners association (HOA). This document is the full set of covenants, conditions, and restrictions (CC&Rs) that bind all lot owners and occupants. It covers what you own, what the HOA maintains, and the rules you must follow.
- What you own & maintain: You own your lot and home; the HOA maintains common areas, entry features, streetscapes, and stormwater measures. The HOA also maintains lawns for specific lots (2, 4, 5, 6, 27, 28, 29, 31, 43). You are responsible for your own home, landscaping, and keeping your lot clean.
- Assessments & fees: Annual assessments are levied per lot, with a maximum of $1,260 for 2006, and can increase up to 10% per year without a vote. Special assessments require a 2/3 vote. There is a $75 initiation fee at each sale. Unpaid assessments accrue 10% interest and can become a lien on your property.
- Leasing & rentals: Lots may be leased, but all leases must be for at least 12 months. Tenants must receive and agree to the governing documents, and lease violations can lead to eviction.
- Architectural review: Any exterior construction, alteration, or landscaping must be approved by the Architectural Control Committee (ACC). Plans are deemed approved if not acted on within 60 days. The ACC can reject for any reason, including aesthetics.
- Parking & vehicles: Vehicles must be parked in the garage or driveway; no street parking. Towed vehicles, boats, RVs, and commercial vehicles are prohibited unless kept in an enclosed garage, and only for up to 48 hours. Garage doors must stay closed except when entering or exiting.
- Pets & animals: Only usual household pets in reasonable numbers are allowed, as determined by the Board. Pets that are a nuisance or endanger health can be removed. No commercial breeding or structures for animals without ACC approval.
- Use restrictions: Lots are for residential use only; no businesses without Board approval. No firearms, no burning trash, no tree removal over 4 inches in diameter without ACC approval. Fences, antennas, and solar panels require ACC approval.
