This is a second amendment to the Declaration of Covenants, Conditions, and Restrictions for Hudson Meadows, a single-family home HOA in Garner, NC. It updates specific rules on parking, assessments, fines, signs, and other restrictions. This document is a partial amendment, not the full rulebook.
- Parking & vehicles: Vehicles may only park on improved surfaces (garage, driveway, or attached paved pad for max 3 vehicles). No RVs, trailers, boats, or vehicles over 10,000 lbs on streets; they may be parked behind the dwelling or screened from view. Commercial vehicles are restricted, and abandoned or inoperative vehicles cannot be visible from other lots or streets.
- Assessments & fees: Annual assessments are uniform for all lots and can be collected monthly, quarterly, semi-annual, or annual. Special assessments require approval by two-thirds of votes present at a meeting. The board can levy special individual assessments for damage, fines, or enforcement costs. Delinquent assessments accrue interest up to 12% per year and late charges, and become a lien on the property.
- Fines & enforcement: The board can fine owners for rule violations up to $50 per day for a first violation and $100 per day for subsequent ones, or the actual cost of abatement, whichever is greater. Fines are treated as special individual assessments. The association can also suspend voting rights and use of common areas, and may tow vehicles violating parking rules.
- Signs: Only one manufactured sign up to 6 sq ft advertising the property for sale or rent is allowed. Political signs up to 4 sq ft are permitted but only from 45 days before an election until 7 days after, and only one at a time. A small home security sign (max 1 sq ft) is also allowed.
- Nuisances & business activity: No noxious or offensive activity is allowed. Businesses are prohibited unless permitted by Wake County, but home offices are okay if no non-resident employees regularly visit. Excessive barking (over 15 minutes without stopping between sunset and sunrise) may be deemed a nuisance.
- Yard maintenance & appearance: Grass must be cut regularly and cannot exceed 6 inches for more than 7 days, and never exceed 9 inches. Building materials, debris, and equipment must be kept in the garage or rear yard, out of sight from the street. All mailboxes must be the same size, material, and style unless the original is unavailable.
