This is the declaration of covenants, conditions, and restrictions for Logan's Manor, a planned community of detached single-family homes in Holly Springs, NC, governed by the Bailey's Hill Homeowners Association. It applies to all lot owners, who automatically become members of the association and are subject to its rules and assessments.
- What you own & maintain: You own your lot and home; the association maintains common areas, including stormwater facilities, private streets, and greenways. Owners are responsible for maintaining their lots and any common area easements on them, and must not alter common areas without permission.
- Leasing & rentals: Leases must be in writing, for at least 12 months, and include a clause binding tenants to the declaration and rules. Owners must provide the association with a copy of any lease. While a home is rented, the owner loses the right to use common facilities.
- Assessments & fees: Annual assessments are set by the board, with a maximum of $1,000 per lot (until 2016, then subject to annual increases up to 10% without member vote). Special assessments may be levied for capital improvements with a 2/3 vote, and an emergency special assessment up to $500 per lot is possible. A one-time $1,000 working capital fee is due at initial purchase.
- Architectural review: Any exterior changes, including buildings, fences, signs, or major landscaping, require written approval from the Declarant (or its delegate) before starting. If no response within 45 days, approval is deemed given.
- Voting & membership: Each lot gets one vote, but the Declarant gets 10 votes per lot it owns until the control period ends (by Dec 31, 2026, or earlier). Owners of leased or vacant homes have their votes capped at 49% of the total.
- Enforcement & liens: Unpaid assessments become a lien on the property and can be foreclosed. Late fees and interest (up to 18% annually) apply. The association can suspend voting and common area use for unpaid assessments or rule violations.
