This is the Declaration of Covenants, Conditions, and Restrictions for Estates at Smith Crossing, a single-family home subdivision in Knightdale, NC, governed by the Estates at Smith Crossing Homeowners Association. It applies to all lot owners in the subdivision and covers property use, maintenance, assessments, and architectural controls.
- What you own & maintain: You own your lot and home; the Association maintains common open space, streets (until accepted by NCDOT), retention ponds, pool, playground, and landscape easements. You must maintain your lot and any fenced areas, and keep grass under 8 inches.
- Assessments & fees: Annual assessments start at a maximum of $700 per lot, can increase up to 10% per year without a vote, and are due monthly. Special assessments for capital improvements require a 2/3 vote of each class. Unpaid assessments accrue 6% interest and become a lien on the property.
- Architectural review: Any building, fence, hedge, wall, mailbox, or other structure must be approved in writing by the Architectural Control Committee before installation. Exterior materials are limited to stone, brick, or hardiplank (vinyl prohibited); homes must be at least 2,300 sq ft heated area; driveways must be concrete; accessory buildings max 224 sq ft.
- Parking & vehicles: Street parking is prohibited. No unlicensed vehicles, tractor trailers, boats, trailers, campers, or motor homes may be parked on streets or visible from the street or adjoining lots. Recreational vehicles must be screened and parked behind the house. Motorized recreational vehicles (dirt bikes, ATVs, golf carts) are prohibited on streets and lots.
- Pets: Household pets limited to two cats and two dogs (total four), but no more than two pets outdoors at a time. Pit Bulls and Rottweilers (or partial breeds) are not allowed. Pets must be leashed or fenced and cannot run free; owners must clean up after them in common areas.
- Use restrictions: Lots are for single-family residential use only. No commercial signs (except small For Sale/Rent signs), no outside clotheslines, no above-ground pools, no satellite dishes over 24 inches, no radio towers, and no home businesses that create abnormal traffic. Garbage containers must be kept out of view except on collection days.
- Fines & enforcement: The Association can fine for violations: $50 for first, up to $100 for second, and at least $100 per week for continuing violations. Fines become a lien on the lot. The Association can also enforce covenants through legal action.
