What Baywood Forest Homeowners Association Inc's governing documents say
Baywood Forest is a single-family residential HOA in Knightdale, NC, governed by a Declaration of Covenants, Conditions, and Restrictions. This document binds all lot owners in the subdivision, covering property use, assessments, architectural control, and common open space.
- What you own & maintain: You own your lot and home; the HOA owns and maintains the permanent common open space. Owners are responsible for maintaining their lot and any easement areas, except for improvements maintained by public authorities or utilities.
- Assessments & fees: Annual assessments fund maintenance of common areas, private streets, drainage, and insurance. The initial maximum annual assessment is $10 per lot, and the Board can increase it up to 10% per year without member vote; larger increases require a 2/3 vote of each membership class. Special assessments for capital improvements also require a 2/3 vote. Unpaid assessments accrue 8% annual interest and become a lien on the property.
- Architectural review: No building, fence, wall, or exterior change (including paint) may be made without written approval from the Board or an architectural committee. Plans must be approved for harmony of external design; if no decision is made within 30 days, approval is deemed denied.
- Use restrictions: Lots are for single-family residential use only. Minimum heated areas apply: 800 sq ft for single-story, 900 sq ft for story-and-a-half (with 600 sq ft ground floor), and 900 sq ft for split-level. Driveways must be paved (concrete or asphalt) unless a gravel exception is granted. No temporary residences, trailers, or outbuildings used as residences. Boats and recreational vehicles must be parked in designated areas. No animals, livestock, or poultry except household pets (not kept for commercial purposes).
- Common open space & amenities: Owners have an easement to use the common open space, subject to HOA rules and fees. The HOA can suspend voting rights and use of facilities for unpaid assessments or rule infractions (up to 60 days). The HOA may dedicate or transfer common open space with a 2/3 vote of members.
- Leasing & rentals: The document does not restrict leasing or rentals; owners may delegate their common area use rights to tenants. However, the document does not specify lease terms or rental restrictions.
