The Cove at Kure Beach is a planned community of 21 single-family lots in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners and residents.
- What you own & maintain: You own your lot and the home on it. The association maintains common areas (e.g., streets, drainage, entrances) and provides exterior maintenance on each lot, including roofs, gutters, exterior surfaces, trees, shrubs, and walks. You are responsible for interior maintenance and personal property.
- Assessments & fees: All lot owners (except the developer) must pay annual assessments set by the board, plus special assessments for capital improvements (approved by 2/3 vote) and insurance premiums. Assessments are a lien on the property; unpaid amounts accrue 14% annual interest.
- Use restrictions: Lots are for residential or residential rental purposes only. No lot may be subdivided. No single rooms may be rented. No use that is a source of annoyance or increases insurance rates is permitted. Owners cannot erect structures that block a neighbor's view.
- Architectural review: No building, fence, wall, or exterior alteration may be made without written approval from the board or an architectural committee. Plans must be submitted; if no decision is made within 30 days, approval is deemed given.
- Leasing & rentals: Lots may be used for residential rental purposes, but no single rooms may be rented. The document does not specify a minimum lease term or other rental restrictions beyond this.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared by the owners who use the wall in proportion to use. If destroyed, the owner who used the wall must restore it unless the other owner agrees otherwise.
- Developer rights & transition: The developer (Declarant) retains special rights (e.g., to complete improvements, maintain sales offices, appoint the board) until December 31, 2039, or until all lots are sold or the developer surrenders those rights. - Stormwater restrictions: The community must comply with a state stormwater permit. The maximum built-upon area (structures, pavement, etc.) is 44,096 square feet. Runoff must be directed according to the approved stormwater plan.
