This document binds all lot owners, residents, and guests to rules about property use, maintenance, and assessments. The community is still under developer control, with the developer retaining special rights until certain conditions are met.
- What you own & maintain: You own your lot and the single-family home on it. The association maintains common elements like stormwater ponds, roads, and open spaces. You must keep your lot free of weeds, debris, and unsightly conditions, and maintain all structures and landscaping.
- Architectural review: All exterior changes, including construction, painting, fences, and landscaping, require prior written approval from the Architectural Committee (or the developer during the control period). The committee has sole discretion to approve or deny based on aesthetics and harmony with the neighborhood.
- Assessments & fees: Annual assessments are set by the board and can be raised up to 10% without owner vote; increases above 10% require 2/3 owner approval. Special assessments for capital improvements need 2/3 vote. A one-time working capital fee of $350 is due from the first non-developer owner. Assessments are a lien on the lot.
- Use restrictions: Lots are for single-family residential use only. No temporary structures, boats, campers, inoperable vehicles, or commercial vehicles may be stored on lots or streets. No clotheslines, storage sheds, or mailboxes on lots. Domestic pets are allowed but must be leashed and not a nuisance.
- Flags & signs: An American or North Carolina flag (max 4'x6') may be flown on a pole no longer than 5'6" attached to the home. No other flags, statuary, or signs (including for-sale signs) are allowed without approval. Political signs are permitted per state law.
- Leasing & rentals: The document does not specify minimum lease terms or restrictions on renting. However, all tenants must comply with the CC&Rs, and owners are responsible for their tenants' compliance.
- Parking & vehicles: Off-street parking for at least 2 cars must be provided on each lot. No inoperable or unregistered vehicles are allowed. Repairs may only be done in garages, not visible from the street. Boats, trailers, and commercial equipment are prohibited without board consent.
