Gracie's Place is a standard single-family homeowners association (HOA) in Leland, NC, governed by the North Carolina Planned Community Act. This declaration applies to all lot owners, tenants, and occupants, and covers 10 lots plus common areas, a private road, and open space.
- What you own & maintain: You own your lot and the dwelling on it. The association maintains common areas (including the private road, drainage, and open space) and carries liability insurance for them. You must maintain your lot free of weeds and debris, and the association may enter and charge you if you don't.
- Architectural review: No structure, exterior change, or fence may be built or altered without prior approval from the Architectural Review Committee (ARC). Minimum dwelling size is 1,500 square feet (ARC may vary by 10%). Exteriors must be completed within 12 months of starting construction. Only one single-family dwelling (max two stories) and approved accessory buildings are allowed.

- Parking & vehicles: Each lot must provide off-street parking for at least two cars before the dwelling is occupied. Boats, trailers, motor homes, and similar vehicles must be screened from view (by wall or vegetation) as approved by the ARC.
- Pets & animals: Household pets are allowed but must not create excessive noise or odor, and must be penned or leashed on your own lot. No animals kept for resale or breeding, and no dangerous animals are permitted.
- Leasing & rentals: The declaration does not restrict leasing terms or require association approval for rentals. However, all tenants must comply with the declaration.
- Stormwater & environmental rules: Each lot's built-upon area (impervious surfaces) cannot exceed 2,677 square feet. A 50-foot vegetative setback must be maintained along surface waters. Roof drains must be released as dispersed flow beyond the setback. Altering drainage or swales is prohibited without state approval.
- Developer control period: The developer retains control of the association and ARC until 90% of lots are sold to non-developer owners. During this period, the developer can amend the declaration unilaterally for certain purposes and can add contiguous properties without member vote.
