Leadmine Lake is a single-family home HOA in Raleigh, NC, with 54 lots and a community lake. This is the full set of covenants, conditions, and restrictions (CC&Rs) that bind all homeowners. It covers architectural control, assessments, use restrictions, and dispute resolution.
- What you own & maintain: You own your lot and home; the HOA owns and maintains the common areas, including the lake, entrance landscaping, and stormwater facilities. You must keep your lot free of tall grass, trash, and debris, and maintain your home to present a pleasing appearance.
- Architectural review: Before building, altering, or even adding lawn ornaments, you must submit plans (including colors) to the Architectural Committee for written approval. Approval is deemed given if no response within 30 days. The committee can reject plans for aesthetic reasons.
- Building & use restrictions: Lots are for single-family residential use only. Minimum heated area: 1,200 sq ft for one-story, 1,500 sq ft for 1.5- or 2-story homes. No manufactured homes, trailers, or temporary structures as residences. No business activity or obnoxious use that disturbs neighbors.
- Leasing & rentals: You may lease your entire home, but leases must be in writing, for at least 90 days, and must state they are subject to the Declaration and Bylaws. Transient or hotel-type rentals are prohibited.
- Pets & animals: No livestock or poultry; only a reasonable number of domesticated household pets, not kept for commercial purposes.
- Parking & vehicles: No boats, RVs, or trailers may be parked in common areas or streets. All vehicles must be stored in your garage or screened from view, and not closer to the street than the front foundation of the house. No inoperative or abandoned vehicles on your lot or streets.
- Assessments & fees: Annual assessments are set by the Board, with a cap of $210 until the first lot is sold, and increases capped at 20% per year unless 2/3 of members approve. Special assessments require 2/3 vote. Late payments incur a $25 charge and 12% annual interest, and the HOA can place a lien on your property.
- Lake use rules: The lake is for owner enjoyment, but no motorized boats (except HOA maintenance), no stored boats, no net fishing, no dumping, and no spotlights across the lake. Owners are responsible for supervising their guests.
