Summit Park Townhomes is a 71-unit townhome community in Chapel Hill, NC, governed by a homeowners association (HOA) that handles exterior maintenance and common expenses. This declaration applies to lot owners, who own their townhome and lot in fee simple, and it also sits within the larger Meadowmont Community Association. The rules cover assessments, architectural control, use restrictions, and maintenance obligations.
- What you own & maintain: You own your townhome lot in fee simple. The association maintains the exterior of buildings and lots (roofs, siding, landscaping, etc.), but you are responsible for your interior, rear yard maintenance (unless the association revokes that right), and any damage you cause.
- Assessments & fees: Monthly assessments fund common expenses, including exterior maintenance and insurance. Initial maximum was $350/month (before 2003), with annual increases capped at 10% or CPI (whichever is greater) without member vote. Special assessments for capital improvements require a 2/3 vote, except the board can approve one up to $1,000 every three years. New owners pay two months' assessment as working capital.
- Leasing & rentals: Leases must be for at least six months, and you can only lease the entire townhome (no room rentals). Leases must be in writing, submitted to the association, and include a clause that tenants are bound by the declaration and rules.
- Pets: Dogs, cats, and other household pets are allowed, but not for commercial purposes, and they must be controlled and not a nuisance. Livestock and poultry are prohibited.
- Parking & vehicles: Boats, trailers, campers, motorhomes, trucks, tractors, and commercial vehicles are prohibited on the property unless parked in a closed garage. Disabled or unlicensed vehicles must be stored in a closed garage. No auto repair on common areas.
- Architectural review: Any exterior changes (fences, additions, landscaping, antennas, etc.) require written approval from the board or architectural committee. Approval is deemed given if no response within 30 days, but incomplete plans don't count. The committee can reject for any reason, including aesthetics.
- Use restrictions: Property is for single-family residential use only. No businesses, yard sales, outdoor clothes drying, or signs (except approved or required). Garbage must be stored inside, and no permanent attachments to roofs or exterior walls without approval.
- Party walls & shared structures: Walls between townhomes are party walls, with shared repair costs proportional to use. Owners have easements for encroachments, overhanging roofs, and access for maintenance.
