What Sycamore Run's governing documents say
Sycamore Run is a townhome community in Chapel Hill, NC, governed by a homeowners association (HOA). This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners, who share party walls and certain common areas. It outlines property rights, assessments, architectural controls, and use restrictions.
- What you own & maintain: You own your townhouse lot and are responsible for its exterior maintenance (e.g., grass, leaves, snow) and for the 'Common Area B' strip of land adjacent to your lot. The association maintains 'Common Area A' (recreation areas) and provides funds for roof, gutter, and downspout repairs.
- Assessments & fees: Annual assessments are levied per lot, initially capped at $300/year ($25/month), and can increase up to 5% per year without a membership vote. Special assessments for capital improvements require a 2/3 vote of each class of members. Unpaid assessments accrue 6% annual interest and become a lien on the property.
- Architectural review: No building, fence, wall, or exterior alteration may be made without written approval from the Board or an architectural committee. If no decision is made within 30 days of submission, approval is deemed granted.
- Party walls & shared structures: Party walls, roofs, and foundations are shared between adjacent lot owners. Repair costs are shared proportionally, and disputes are resolved through arbitration. Owners have easements to access adjoining lots for construction and maintenance.
- Use restrictions: Property must be used for residential purposes only. No obnoxious or offensive activity, trash, or wrecked vehicles may be left outside. Signs are limited to 'For Sale' or 'For Rent' signs and those used by the declarant.
- Parking & easements: Each lot owner is entitled to use up to two automobile parking spaces, located near their lot. Owners share ingress-egress easements over driveways and walkways with the adjacent lot owner sharing the party wall.
- Insurance: The association obtains master casualty and liability insurance on common areas and on individual buildings (roof, party walls, foundations) as a common expense. Each owner is responsible for insuring their personal possessions and general liability.
- What this document doesn't cover: This excerpt does not include the full bylaws, rules and regulations, or details on amenities beyond the existence of 'Common Area A' recreation tracts. It also does not specify pet rules, rental restrictions, or age restrictions.
