This is a standard single-family homeowners association (HOA) for Volusia Point and Pinellas Bay subdivisions in Sneads Ferry, NC. The rules bind all lot owners, who automatically become members of the association. The document is the association's bylaws, which govern how the board operates, meetings, assessments, and enforcement—not the full declaration of covenants (CC&Rs).
- What this document covers: These bylaws define the association's structure: board of directors, officers, meetings, voting, committees, assessments, and enforcement procedures. - Meetings & voting: Annual member meetings require 51% quorum; if not met, a second meeting has no quorum requirement. Members may vote by proxy. Board meetings must be at least quarterly, with a majority of directors constituting a quorum.
- Assessments & liens: Each lot owner must pay assessments as set by the board. Unpaid assessments become a lien on the property, accrue interest at the highest legal rate, and the association may foreclose or sue. Non-use of common areas does not excuse payment.
- Fines & enforcement: Violations of the Declaration, bylaws, or rules can result in fines of $100 per day. Before fining or suspending voting rights, the board must provide notice and a hearing. The association may also enter the lot to abate violations at the owner's expense.
- Rental rules: The board may adopt rules governing rentals, including lease forms and tenant conduct, and may limit the number of occupants. The board can also bring eviction actions on behalf of owners against noncompliant tenants.
- Audit committee: Once all lots are sold, an annual audit committee of three non-board owners reviews financial records. Owners or mortgage holders can request a CPA audit at their own cost.
