Tuscany Villas is a planned community of townhome lots in North Topsail Beach, NC, governed by a homeowners' association (HOA). This Master Declaration of Covenants, Conditions and Restrictions (CC&Rs) establishes the rules for the community, binding all lot owners, residents, and guests. It covers land use, architectural review, maintenance responsibilities, assessments, and restrictions on vehicles, pets, and rentals.
- What you own & maintain: You own your lot and the townhome on it. The HOA maintains common areas, streets (unless accepted by the state), entry features, and stormwater systems. You must maintain your lot's exterior, including painting, roofs, and landscaping; if you fence your rear yard, you may maintain it, but the HOA can step in if it's neglected.
- Leasing & rentals: Leasing a lot is allowed and is not considered a business. There is no minimum lease term stated in this document, but all leases must comply with the community's rules and occupancy limits.
- Pets: You may keep up to three dogs or cats (combined) as household pets. Aggressive breeds (Rottweilers, pit bulls, chows, Dobermans, Mastiffs, Boxers, bulldogs, wolf hybrids) are banned. Dogs must be leashed outside, and you must clean up after them. Pets must be registered and inoculated as required by law.
- Parking & vehicles: Only licensed, operative passenger cars, station wagons, pickup trucks (≤2.5 tons), and passenger vans may be regularly parked in driveways. No boats, RVs, campers, or vehicles over 5,000 lbs empty weight may be parked overnight. Guest parking for such vehicles is limited to 7 days per year. No vehicle may be used as a dwelling. On-street parking is subject to HOA and city approval.
- Architectural review: Any exterior changes (buildings, fences, landscaping that acts as a fence, etc.) require prior written approval from the Architectural Review Committee (ARC). The ARC can deny based on aesthetics alone. During the Declarant Control Period, the developer controls the ARC. Plans are deemed approved if no response within 30 days. Approval expires if construction doesn't start within one year.
- Assessments & fees: All lots pay equal Base Assessments, initially $35/month. The HOA can increase assessments up to 20% per year without a vote; larger increases require a 2/3 vote. Special assessments for capital improvements also require a 2/3 vote. Unpaid assessments accrue 12% annual interest and become a lien on the lot.
- Use restrictions: Lots are for single-family residential use only. Home businesses are allowed if not detectable from outside, comply with zoning, and don't increase traffic. No temporary structures, mobile homes, or modular homes. Minimum dwelling size: 1,200 heated sq ft (first floor at least 600 sq ft). No clotheslines visible from roads or other lots. No swimming pools except small kiddie pools (≤4 ft diameter). Fences must be vinyl/PVC, no wood or chain link, and are limited to rear yards.
