This is an ancillary document that governs shared amenities (a swimming pool) between two separate communities in North Topsail Beach, NC: Shipwatch Villas Condominium (condo units) and Shipwatch Villas Townhomes II (townhomes). It does not contain the full rules for either community—only the rules for using and paying for the pool.
- Amenities covered: The only amenity covered is the swimming pool area, including all improvements, furniture, fixtures, and equipment.
- Who can use the pool: Owners, their heirs, lessees, and authorized resident guests of both the condominium and townhome communities may use the pool. Use may be extended to third persons by the Condo Association board for a reasonable fee.
- Cost sharing & assessments: Pool operating costs are split between the two associations using a formula: three-bedroom units are weighted 1.3 times a two-bedroom unit. Each association collects from its owners per its own governing documents. The Condo Association may levy special assessments for capital expenditures on the existing pool only.
- Suspension of pool access: Pool use may be denied to any owner, lessee, or guest who is more than 15 days late on any assessment. If the Townhome II Association is more than 30 days late on its lump-sum payment, all townhome owners' pool rights may be suspended.
- Rules & regulations: The Condo Association board may adopt rules on hours, minimum age, safety, items in the pool, fines, and user identification. An Amenities Committee (one member from each association plus property managers) advises on rules and budget.
