What Cape Island's governing documents say
This is a set of amendments to the restrictive covenants for Cape Island, a subdivision in North Carolina. It primarily governs the use of a community docking facility and prohibits individual piers on certain lots. The rules apply to lot owners in the subdivision.
- Boatslip assignment & transfer: Boatslips (1–10) are assigned to lot owners via recorded instruments. They can only be transferred to another lot owner in Cape Island. If a lot is conveyed, all boatslips owned by that lot owner are automatically transferred unless the deed explicitly states otherwise.
- Community docking facility: The docking facility is common property maintained by the Committee. Use is subject to Committee rules and any surcharges. The facility includes a 15-foot easement for access and utilities.
- Individual pier prohibition (Lots 11, 15, 16, 22, 23): On these five lots, construction of individual piers or docking facilities is prohibited as long as the community docking facility is built and maintained. If the community facility is destroyed and not rebuilt, individual piers may be permitted again.
