What Island's governing documents say
This is a set of covenants, conditions, and restrictions (CC&Rs) for two adjacent single-family home subdivisions in North Topsail Beach, NC: Cape Island (lots 7-8, 13-58) and Wyndy Dunes (lots 13-17). The rules apply to lot owners and govern residential use, construction, maintenance assessments, and architectural review. The document is a partial rulebook covering only these subdivisions, not the entire Island community.
- Residential use & restrictions: Lots are for single-family residential use only. No business, multifamily, hotel, or bed-and-breakfast uses are allowed. Home offices are permitted only if no public visits, no on-site employees other than residents, and no frequent deliveries or client visits.
- Minimum dwelling size: In Cape Island's Cape Pointe area, single-story homes must have at least 1,800 sq ft of heated floor area; two-story homes need at least 2,000 sq ft (bottom floor at least 1,000 sq ft). Outside Cape Pointe, minimums are 1,600 sq ft for one story and 1,800 sq ft for two stories (bottom floor at least 1,000 sq ft). In Wyndy Dunes, each dwelling must have at least 850 sq ft of living space.
- Architectural review: All exterior construction, modifications, or landscaping (including painting, fences, pools, antennas, tree removal) require prior written approval from the Declarant or Committee. A $1,000 deposit ($200 non-refundable review fee) must accompany final plans. Approval is based on harmony with surroundings and aesthetic factors. Construction must be completed within one year.
- Assessments & fees: The Declarant or Committee may levy special assessments for maintenance of common areas, roadways, and capital improvements. Assessments are a lien on the lot and the personal obligation of the owner. Delinquent assessments accrue 12% annual interest and may be enforced by foreclosure. After turnover, special assessments require 2/3 owner approval (Cape Island) or 50% (Wyndy Dunes).
- Pets & animals: No livestock or poultry. Up to two domestic pets (dogs or cats) are allowed, but must be kept on a leash or in a secure fenced area when outside. Owners must pick up droppings on roads or other owners' property.
- Parking & vehicles: No junked or inoperable vehicles. All vehicles must have current registration and inspection. Parking is allowed only on designated driveways, not on streets. No trucks over one-ton capacity, mobile homes, trailers, or campers may be parked overnight visible from other lots or streets.
- Impervious surfaces & stormwater: Impervious surfaces (structures, paved areas) on any Cape Island lot cannot exceed 5,124 sq ft (or 25% of the tract overall). In Wyndy Dunes, the limit is 2,974.9 sq ft per lot. These limits are to comply with North Carolina stormwater rules and may be enforced by the state.
