What Villas by the Sea Architectural's governing documents say
Villas By The Sea is a residential subdivision in North Topsail Beach, NC, governed by a master declaration of covenants and restrictions. It includes a mix of single-family homes, townhouses, and multi-family units, with an architectural control committee and a community services association. These rules apply to all lot owners and residents.
- Architectural review: All exterior changes (buildings, fences, landscaping, etc.) require prior written approval from the Architectural Control Committee. Plans are deemed approved if no response within 30 days. Refusal can be based on any ground, including aesthetics. Appeals go to the Board of Directors.
- Assessments & fees: Annual assessments start at $245 per month per dwelling unit (not including insurance). Assessments can increase up to 15% per year without a vote; higher increases require 51% member approval. Special assessments for capital improvements also require 51% approval, except for insurance-related costs.
- Leasing & rentals: Unit owners may lease their units, but leases must be for the entire unit (no subdivision). A copy of the lease and rental management agreement must be provided to the association. The board can regulate rentals, including pet rules, trash pickup, parking, and pool use. There is no minimum lease term, and vacation rentals are allowed.
- Pets & animals: Household pets are allowed but not for breeding or commercial purposes. Prohibited dog breeds include Rottweiler, Doberman, Mastiff, Boxer, Bulldog, Pit Bulls, Chows, and wolf hybrids. The association may add to the prohibited list. Pets must be leashed off the owner's lot.
- Parking & vehicles: At least one paved off-street parking space required per vehicle. On-street parking is prohibited except for temporary gatherings. No vehicles over 7,100 lbs empty weight, boats, campers, or motor homes may be parked on lots without association regulation. No vehicle repair or storage on blocks.
- Residential use & home businesses: All lots are for single-family residential use only. Home businesses are allowed only if not detectable from outside, comply with zoning, involve no client visits, and are consistent with residential character. Leasing is not considered a business.
- Maintenance responsibilities (multi-family units): For multi-family units (townhomes/condos), the association handles all exterior maintenance (roof, siding, windows, decks, landscaping, etc.). Owners are responsible for interior maintenance, including appliances, HVAC replacement, and interior surfaces. The association may step in if the owner fails to maintain.
