What Long Beach's governing documents say
This is a set of two unrelated documents recorded in Brunswick and Onslow Counties, NC. The first is a Declaration of Restrictive Covenants for a single lot (Long Beach/Oak Island) that binds the co-owners of that lot. The second is a Declaration of Intent to Affix a Manufactured Home to real property in Onslow County, filed by a lender. Neither document creates a community-wide HOA or condominium regime.
- What this document covers: The first document is a private covenant among co-owners of a single lot (Lot 3, Block 87A, Long Beach/Oak Island). It does not create an association or apply to other properties. The second document is a lender's declaration that a manufactured home is permanently affixed to a different property (183 Wildcat Pond Road, Hubert, NC) and should be treated as real property.
- Dock & boat lift use (first document): The dock, boat lift, and all other structures on the lot may be used only by the owners of the property. Tenants renting any other property of an owner may not use them.
- Expense sharing (first document): The co-owners must share all expenses for the property, including taxes, insurance, utilities, and maintenance fees, except for boat lift maintenance (see below).
- Boat lift exclusivity & maintenance (first document): The westernmost boat lift is for the exclusive use of Graham S. Oldham and Mary L. Oldham (and their successors), who are solely responsible for its maintenance. The easternmost boat lift is for the exclusive use of Hugh W. Clark and Patricia N. Clark (and their successors), who are solely responsible for its maintenance.
- Right of first refusal (first document): Before selling their ownership interest in the property, any co-owner must give the other co-owners a right of first refusal. If a co-owner declines to purchase, they must deliver a signed waiver to be recorded.
- Amendment & severability (first document): These covenants can be removed or modified only by unanimous action of all owners. If any covenant is invalidated by a court, the others remain in full force.
- Manufactured home affixation (second document): The second document declares that a 1999 Master Piece manufactured home (serial 02121481G) placed at 183 Wildcat Pond Road, Hubert, NC is intended to be treated as real property, taxed as real property, and included in any conveyances or encumbrances of the land.
