This is a Declaration of Restrictive Covenants for Buckhead Subdivision, Phase 1 (lots 15-29) in Surf City, NC, a single-family residential subdivision. The covenants run with the land and bind all current and future lot owners.
- Land use & building type: Lots are limited to single-family dwellings only; no duplexes, triplexes, quad-plexes, mobile homes, doublewides, or pre-manufactured homes. A single family is defined as persons related by blood or marriage, or a single individual; fraternities, sororities, family care homes, and boarding homes are prohibited.
- Dwelling size & height: Minimum ground floor area: 900 sq ft for one-story dwellings, 700 sq ft for dwellings of more than one story (excludes open porches and garages). Maximum height: 2.5 stories.
- Impervious area limit: Maximum impervious area per lot is 3,000 sq ft (including right-of-ways, structures, pavement, walkways, patios of brick/stone/slate, but not wood decking). If two lots are combined, the limit is 6,000 sq ft.
- Setbacks & lot combination: Buildings must meet minimum front, side, and rear setback lines shown on the recorded plat or Onslow County subdivision regulations. Two adjacent lots may be combined for a dwelling, but the remaining portion must be at least as large as the smallest numbered lot.
- Fences: No fence between the front building line and street right-of-way except decorative fences (split-rail or picket) no more than 3 ft high; chain link is not decorative. Fences behind the front building line may be up to 6 ft high. Corner lots have additional restrictions.
- Pets & livestock: No livestock or poultry allowed. Dogs, cats, or other household pets are permitted but not for commercial purposes. Goats, cows, horses, and ponies are not considered household pets.
- Vehicles & storage: No unused or junk cars or parts may be kept on any lot. No more than two cords of wood may be stored, and none sold from the lot. Trailers, mobile homes, campers, or similar vehicles must be parked behind the main dwelling or inside a carport/garage.
- Signs: Only one professional sign (max 1 sq ft, parallel to building line), one for-sale/for-rent sign (max 3 sq ft), and builder signs during construction and sale period are allowed.
