What Larkspur's governing documents say
This is a set of protective covenants for Larkspur, a single-family residential subdivision in Buncombe County, NC. The rules bind all lot owners and are enforced by the developer or a homeowners association. The document covers land use, building standards, setbacks, pets, and road maintenance obligations.
- Land use & building type: Lots are for single-family residential use only. No re-subdivision into additional lots, and no mobile homes. Modular or prefabricated homes require prior written approval. Only one dwelling and a private garage (max 3 cars) per lot.
- Dwelling size & quality: Minimum heated floor area: 1,600 sq ft for one-story homes (excluding garage/decks); for multi-story, main level at least 1,000 sq ft and second story at least 600 sq ft. Construction must be quality workmanship and materials.
- Setbacks: Homes must be set back at least 40 ft from the center of any road right-of-way, 30 ft from rear property lines, and 25 ft from side property lines. A later waiver reduced the side setback for Lot B to 20 ft.
- Pets & animals: No livestock or poultry. Household pets allowed but must be kept under control and not roam free. Maximum of 2 dogs or 2 cats per lot.
- Parking & vehicles: Driveways must be at least 10 ft wide and paved with asphalt, concrete, or other hard surface. No permanent parking of trailers, boats, RVs, or unsightly vehicles visible from roads or neighboring lots.
- Architectural review: All plans and specifications, including exterior colors and landscaping, must be submitted to the Developer (or an architectural committee) for written approval before construction. Approval can be denied on aesthetic grounds.
- Road maintenance & assessments: Roads are private. Owners share maintenance costs. For Larkspur Subdivision, owners of Lots D and E pay $300/year each for road maintenance; all owners pay $50/year for entrance/common area upkeep. For Larkspur Estates, owners pay at least $25/month for road and utility maintenance.
