What Ives Landing Homeowners Association II, Inc's governing documents say
This is a first amendment to the Declaration of Covenants, Conditions and Restrictions for Ives Landing II, a single-family HOA in Johnston County, NC. It adds rental restrictions to the existing rules, so it's a partial update rather than a full rulebook. It applies to all lot owners in the community.
- Leasing & rentals: Lots must be owner-occupied, except that up to 10% of lots may be leased. Leases must be in writing for at least six months, and tenants must sign an acknowledgment that they'll follow the HOA's governing documents. Owners are liable for their tenants' violations.
- Short-term rentals: Transient hotel purposes, including AirBnB-type rentals, are prohibited.
- Grandfathering: Lots leased as of the amendment's filing date are grandfathered and may remain leased even if the 10% cap is exceeded, but only if they stay continuously leased; a vacancy of more than 60 days ends the grandfathered status.
- Occupancy limits: No lot may be occupied beyond Johnston County's allowable occupancy limits.
- What this document doesn't cover: This is only an amendment adding rental restrictions; it doesn't cover other HOA rules like architectural review, pets, parking, or assessments. Those are in the original Declaration and other governing documents.
