Bear Creek North HOA is a standard single-family detached home community in Parker County, Texas. These Bylaws establish the governance structure for the homeowners association, including the board of directors, officers, meetings, and voting procedures. They apply to all lot owners and occupants. The Bylaws do not contain specific rules on topics like pets, leasing, or architectural guidelines—those are in the separate Declaration of Covenants, Conditions, and Restrictions.
- Board of Directors: The board has 3 to 5 directors elected by members for staggered three-year terms. Directors must be lot owners (or authorized representatives of entity owners). Co-owners of a single lot cannot both serve on the board. Vacancies are filled by board appointment for the unexpired term.
- Officers: Principal officers are President, Vice President, Secretary, and Treasurer, elected annually by the board. The President and Secretary must be directors; other officers need not be. Co-owners of a single lot cannot both serve as officers or one as officer and another as director (except during Declarant control).
- Meetings & Voting: Annual meetings are held in February or March. Special meetings may be called by the board or by petition of 20% of members. Quorum is 10% of members present in person or by proxy. Voting can be in person, by proxy, absentee ballot, or electronic ballot. Majority vote decides most matters unless a higher percentage is required.
- Membership & Voting Rights: Each lot owner is a member with one vote per lot. Declarant (developer) holds a Class A membership with 10 votes per lot until control is transferred. Class B members (all other owners) have one vote per lot. Co-owned lots have a single vote exercised by majority interest. Entity-owned lots may be voted by an authorized officer or manager.
