This is a supplement to the community manual for Avery Pointe, a single-family home HOA in Allen, TX. It updates specific policies to comply with 2021 Texas legislation, but it is not a complete set of rules — the full governing documents (declaration, community manual) must also be followed.
- Covenant violation hearings: If you receive a violation notice and are entitled to cure, you have 30 days from the notice date to request a hearing. The board must hold the hearing within 30 days of receiving your request. You may postpone once for up to 10 days, and if the board fails to give you evidence 10 days before, you get an automatic 15-day postponement. Both sides may audio-record the hearing.
- Board meeting notice: Regular board meetings: notice must be mailed 10–60 days in advance, or posted/emailed at least 144 hours before. Special meetings: same mail window but 72 hours for posted/email. Certain major actions (e.g., fines, foreclosure, budget approval) must happen in an open meeting with prior notice (after the developer period ends).
- Pool enclosures & security measures: All pool fencing and security improvements require written approval from the Architectural Control Committee (ACC). Pool enclosures must be black, transparent mesh in metal frames, no more than 6 feet high, and not climbable — and the ACC cannot deny them if they meet law and specs. Security fencing in front yards is discouraged; if allowed, it must be 48–60 inch ornamental wrought iron (black) with specific dimensions.
- Delinquent assessment collection: Before the association can use a collection agent or report you to a credit bureau, it must send a certified letter giving you at least 45 days to cure the delinquency. The notice must list amounts and options for a payment plan. The association must also give 30 business days' notice before reporting to a credit agency, and cannot report amounts under dispute.
- Religious displays: Owners/residents may display religious items motivated by sincere belief, subject to restrictions: no threat to health/safety, no illegal content, no installation on common property or easements, no attachment to traffic devices, etc. The association cannot enforce any conflicting prior restrictions.
- Management certificate & document access: The association must keep current governing documents online and file a management certificate with the county and Texas Real Estate Commission, updated within 30 days of any change.
