Windgate Townhouses is a townhome community in Arlington, TX, governed by a homeowners association (HOA). This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that binds all owners, and it covers assessments, maintenance responsibilities, use restrictions, and architectural control. It is a full rulebook for owners, not renters.
- What you own & maintain: You own your townhome unit and the lot it sits on, but the association maintains common areas, the private drive, fences, roofs, exterior walls, and landscaping. You are responsible for interior maintenance and any exterior items not covered by the association.
- Assessments & fees: Annual assessments are set by the Board, with a maximum increase of 120% per year (after the initial $180 per lot). Special assessments may be levied for capital improvements with owner approval. Assessments are paid in two semi-annual installments due May 1 and November 1.
- Leasing & rentals: Leases must be in writing and must include a provision that the tenant agrees to comply with the Declaration and rules. Non-compliance by the tenant is a default under the lease. There is no minimum lease term stated in this document.
- Pets: You may keep a reasonable number of dogs, cats, or other household pets, but they cannot be bred or kept for commercial purposes. Livestock and poultry are prohibited.
- Architectural review: Any exterior changes, including buildings, fences, walls, painting, or staining, require written approval from the Board or an architectural committee. If no decision is made within 30 days, approval is deemed granted.
- Parking & vehicles: Parking spaces cannot be used for storage of boats, trailers, motor vehicles, or other equipment without permission. The Board can regulate parking on the private drive.
- Use restrictions: Properties are for residential use only. No commercial activities, advertising signs (except one small for-sale/for-rent sign), or exterior antennas are allowed without approval. No planting or gardening outside patio areas, and no fences or walls except as originally built or approved.
- Party walls: Shared walls between townhomes are party walls, and repair costs are shared equally between adjoining owners. If damage is caused by negligence, the responsible owner bears the full cost.
